If you'll remember the story, Joe Horn, a 61-year-old Pasadena, Tex., resident spotted two burglars breaking into his neighbor's home in Nov. 2007. He dialed 911, but despite being warned to stay in his home, he declared that he has a right to use deadly force to defend his neighbor's property and that he was going to confront the robbers.He does just that and then shoots them in their backs, killing them. A huge controversy ensued over whether he should stand trial in the deaths of do RiascosDiego Ortiz, 30, and Hernan Torres, 38, both Columbian immigrants.
Yesterday, a grand jury cleared him of all wrongdoing. Score another one for the gun nuts.
On Tuesday, family and activists called the killing "premeditated murder." ...
I'm not defending the two men who robbed the neighbor's home of about $2,000 in jewelry and cash. But was this worth their lives? These men were not armed, and they posed no threat to Horn, although he claims that they came into his yard.
But if you hear the 911 tapes, Horn was warned to stay in his home and let the police handle the issue. He ignored the dispatcher's orders and if you listen to the tapes you'll see that he had every intention of killing those men.
Even though Horn has expressed regret over the incident, there are supporters who swear Horn should have sawed the men's heads off and impaled them on a lamppost at the edge of his driveway. These are the people who I lose sleep over.
These are the people who love guns far more than they love anything else and are waiting for their chance to kill someone, and far too often they are looking for a nonwhite in order to get their chance. For example, the 1992 killing of Yoshihiro Hattori, a 16-year-old Japanese exchange student in Baton Rouge, La., who simply rang the wrong doorbell when looking for a Halloween party. The homeowner, Rodney Peairs, opened fire on Hattori, mortally wounding him. Peairs was later acquitted under a Louisiana law, similar to one in Texas that allows people to shoot burglars if they feel threatened.
Here's my question: If people like Horn and Peairs -- who are white -- can shoot people they feel threatened by, why is it that John White, a Long Island, N.Y., man -- who is black -- gets a jail term for defending his home when he thought a mob was coming to harm his son, which also resulted in a death.
None of the losses of life are right. The deaths are senseless, and could have been avoided if cooler heads had prevailed. But in Horn's case, he had no intention of calming down. He took the law into his own hands and now, with a Supreme Court gun decision having just passed, every firearm freak in the country will feel emboldened.
Well, here's what I have to say to them: a person who would shoot someone because they feel a gun empowers them is a sociopath with a murderous mentality. It has nothing to do with self defense, it is the mark of a weak person who would feel castrated without having a gun somewhere in their vicinity.
Point blank: If you actually love your gun, you're a punk. It takes a man to preserve life. It takes a weakling to snuff it out.
Horn, by his own admission, is an eternal victim of his weak moment.

The short answer to your question about why Mr. White is in jail is that Texas is not NY. If it had been Texas, Mr. White probably would have been no-billed by the grand jury. Don't blame Texans for the nutty NE gun laws.

The Texas Penal Code (9.41, 9.42 and 9.43) pretty well spells it out. The law requires a couple of reads paying attention to all the "and's" and "or's"
to figure it out. Personally, I don't think I would have gone outside to confront the two burglars. But, while everyone seems to be focused on whether or not Joe Horn was "scared for his life" there is another provision in the law that probably covers him.
Law abiding Floridians probably have greater protection from criminal AND civil prosecution with the "Stand and Shoot" laws approved in their state.
The Florida Statute is 776.

If the Feds had been doing their job, these two guys would not have even been in the U.S. - THEY WERE ILLEGALS! The Black father who was protecting his son from a gang would not have gone to prison if he lived in Texas. This is what you get for your liberal Eastern society. Shut up about it or vote them out.

I am so sick and tired of people complaining about racism in this case. The people that Joe Horn shot were criminals. They had no right to be braking into somebody's house in the first place. They were comming towards Joe Horn before they turned around. I think two thirty year old men against one sixty year old man, was enough for Joe Horn to fear for his life. For those who care more about the two low lives that died while committing an illegal act, go screw yourselves. It sickens me that you people are so determined to create a safe environment for burglers.

It would have been so much better if Horn hadn't had that shotgun. Then the two burglars could have beaten him to death and escaped without a witness. Instead of two fine upstanding citizens dead it would only be one worthless old white dude.
Or maybe he should have just ignored the whole thing, let them go without interferring. Then they'd be free to continue their happy lives of fun and games, helping themselves to the hard earned posessions of honest folk. After all Estados Unidos only exists for the poor immigrants to come to, work hard, and send the money back to mamacita.

Just to clarify a few things here for people:
1) The 911 operator's suggestions are just that - suggestions. They carry no legal weight or authority.
2) There is NO Supreme Court case requiring one to retreat
3) Texas law, which is what governs this issue, allows lethal force to be used in defense of property or to stop a felony in progress.
4) This was not an application of the death penalty. It was a crime being stopped in progress.
5) The racist comments about white people being inhumane are unnecessary. There is nothing inhumane about stopping a criminal in the middle of a crime. Keep your racism and ignorance to yourself.
6) There is no risk of a civil action against Horn. The law does not allow it.
7) Yeah - there are two dead criminals. So what? That they are dead is their own damn fault. Had they NOT chosen a life of crime, they would be alive now.

The writer is trying to stir up unrest and animosity with this poorly written and thoughtless article.
The ignorant writer, hoping his readers are stupid: Couldn’t find a Texas incident to prove his point, instead he had to go back OVER 15 YEARS and to another STATE to dredge up something, and even then it was nothing even close!
Compare the two incidents: A foreign student was tricked into behaving stupidly, and was tragically killed by a careless homeowner. How does that compare to these two CRIMINALS, who broke into a citizen’s home and was killed as Texas law allows for stopping serious crimes?
Hopefully, the CRIMINALS’ shack-up and next of kin will be barred by the “Castle law” from seeking civil robbery of Mr. Horn for his public service.
Has our Black communities lost their minds by supporting the two CRIMINALS over JUSTICE?
“Oh, but they hadn’t hurt anybody! Theys just a stealin’ from some honkey, and that cracker done shoot ‘em in the back!”
And all they would have had to do, to avoid being shot was to have stayed in their country, or simply NOT broken into a citizen’s home.

A Black man charged with murder and sentenced to death for killing a white B&E CRIMINAL (illegally kick in a door, Cop or not, you deserve to be shot. PERIOD.)
