
The headline was brutal and grabbed national attention. A female Hofstra University student reported being lured to a bathroom stall, restrained by her wrists, and gang raped by five men; one of them a fellow student. Four of the five suspects were quickly rounded up and arrested. But they all claimed their innocence and protested that the sex was consensual.
They were telling the truth. Late Wednesday night, the accuser fully recanted her accusations and the suspects were cleared of all charges. According to Newsday:
After hearing the news, prosecutors convened a late-night court hearing at First District Court in Hempstead, where Judge Robert Bruno signed an order dismissing the charges against the four men in the case, Rice said.
They were released a short time later from Nassau County Correctional Center in East Meadow and were greeted by family members who embraced them, laughing and weeping with joy. "I'm happy," said Kevin Taveras, 20, of Brentwood, as he walked from the jail. "I just want to go home now." Asked what the past few days have been like, Taveras, who works for Cablevision, Newsday's parent company, said, "It was terrible. It was terrible. I feel like our names were tarnished. But maybe with all the news out, people will see we're not rapers."
In a phone conversation late Wednesday night, Stalin Felipe, 19, another of the accused, said he was relieved. "I'm feeling great right now," said Felipe, who was with his sister, Carol Felipe, and Taveras at a relative's home in Brentwood. "Me and [Taveras] were smiling. We couldn't believe this was true. What a nightmare. I appreciate that this young woman finally told the truth. And it's easy to presume that her sexual behavior, with relative strangers, is symptomatic of deep emotional distress. Nonetheless, there must be significant consequences for crying rape when there is none.
Personally, I'm beating myself up a little bit because of how easy I found it to believe the accuser's story. I regret that didn't notice, until now, that in the press coverage of this story, the word "alleged" was hard to find. Theoretically, we are all innocent until proven guilty. But when I first read this story I thought of "Dunbar Village" not of the "Duke rape case". These young men now have to get past having their names blasted out in connection to this crime. After all, we will have to see if the story about the lie gets as much press as the original charges.
Outside the jail just before 11 Wednesday night, Felipe said he wants to move on. "I don't even have any hard feelings," he said. "I am happy to be alive. To be a caged animal when you are not guilty is the worst." But he added, "I'm 19. I have my whole life in front of me, and suddenly it was all over. I was facing 5 to 25 years in jail."
As for what he's going to do next, Taveras was concerned about his job. "I'm going to try to get my job back. HR called me and left a message, but I never got it because I was locked up." Despite what happened, Taveras felt concerned for his accuser. "I don't know why she said what she did say. I hope she doesn't go through what we went through." Source: Newsday

The story didn't make sense from the start. I get the whole, protect the identity of the victim thing. But these men have been named and sent to jail for three days. Now's the time to name the girl, and send her to jail for much longer.

I agree with what you said about this being the time to release this young woman's name, and ethnicity. Since the young men had their names released, it seems almost as soon as they were arrested. Now we want to know the idenity of the real culprit.

This rape may have actually happened. In order for the victim not to relive the tragedy all over again, they sometimes change their stories just not to relive that horrible night mare that have to be discussed repeatedly. She may be experiencing traumatic stress and choices not to keep hearing it over and over again. The men are smiling now, but they have answer to God. This could have been avoided if they respected themselves and women.

I am glad that the Truth has come out concerning the actions of all involved.
Yes the young woman should not have lied, BUT, the young men should understand that everything that is offered to them for free--may not be for them!
They are at fault of being lead by their desire to 'get some' from a young woman they new nothing about. Next all involved need to be tested for STD's if condoms were not used!
I hope they have all learned a Character Changing lesson!

I couldn't agree more. Just because the sex was consensual that doesn't mean they are innocent of any kind of moral wrongdoing. All 6 of the people involved are disgusting and terribly misguided with very little moral decency. There is a good reason to be thankful that 5 young men didn't go to jail when no crime has been commited, but there is nothing to celebrate in situation where 6 young people (5 men and 1 woman) had group sex in a bathroom stall. There are very real consequences for sexual deviancy and promiscuity and these young men had to endure spending 3 days in jail, but even without that the outcome could easily be a trip on Maury and/or a trip to the clinic. I am in no justifying what the woman did...she needs to face the music and it is terribly unfair that her identity is being protected while these men have been outted. It's an all around tragic situation and there are no winners here.

Women don't seem to realize how hard "crying wolf" makes it for those who have real crimes perpetrated against them. This is the reason real rape victims are so reluctant to report crimes. It is also the reason that the Police don't exactly jump when they hear "rape";they sit still a while waiting for the truth to come out. Meanwhile, a true "victim" is neglected.
The young woman who did this, should have some kind of charge pressed against her even it only results in a fine. People have got to see that they cannot make false reports with no personal reprecussions. These young men spent time in jail for something they never did and there will always be a segment of the population who will not believe them,so their lives will never be quite the same.
Women reporting false rapes, false kidnappings and so forth, don't seem to care that they are playing with people's lives. It is just a matter of time before someone gets killed based on one of these false reports(some family member/friend will take the law into their own hands before the truth comes out) and you can bet it will be a young Black man that gets killed!
People,women especially, have got to stop falsely reporting crimes. False reports hurt everyone.

It is sad that this young lady lied about being rapes. Its also sad that these young men see nothing wrong with their behavior. They all acted liked animals. This is the reason STDs are spreaded throught out the land.
