
Heather Ellis of Kennett, Mo., has quite a story to tell. It all started nearly three years ago in a local Wal-Mart.
Ellis was shopping in the store with a cousin, and the two temporarily parted ways to find the shortest line. Seeing that the other line was moving faster, Ellis went to get in line with her cousin.
She was accused of cutting the line by a store employee, who then notified the security guard. According to Ellis, she was shoved by another customer, had her items pushed to the side and was shortchanged when she finally checked out. The police affidavit states that Ellis was belligerent, loud, abusive and cursing when she was told to leave the store by the assistant manager.
Ellis' aunt, Lily Blackmon, received a frantic call from her son and claims that when she arrived, her daughter's head was being repeatedly banged against the police car as she told officers that she wasn't resisting arrest. Blackmon, who was a probation officer in the town for 11 years, asked the officers why her niece was getting such rough treatment.
"I said, 'What is going on?' And all [the officer] could say was, 'She cursed,'" said Blackmon.
Ellis was charged with disturbing the peace, trespassing, resisting arrest and two counts of assaulting a police officer. She was then offered a plea deal by Dunklin County Prosecutor Stephen Sokoloff. The prosecutor offered to drop the felony counts to one misdemeanor of disturbing the peace, as long as Ellis signed the plea deal. Her aunt claims that the deal was offered so their family wouldn't file a lawsuit.
Ellis refused to take the plea deal, claiming that she wasn't willing to admit to something she didn't do; however, 11 months later, the misdemeanor counts were dropped, which seemed to be good news. The good news, though, was replaced with something even more disturbing.
It turned out that the misdemeanor counts had been replaced by felonies. Ellis now faces 15 years in prison if convicted. When her aunt went to prosecutor Sokoloff to find out what happened, Sokoloff allegedly told her, "Mrs. Ellis, when you get through, I don't care what you say. You may as well take my way out. My way was the plea bargain. If you don't take that way, I can assure you, you'll never win in here."
Ellis claims that her pending convictions have cost her two jobs and the chance to enter medical school, but she still refuses to sign the plea deal. Racism recently entered in to the story when Ellis was handed KKK cards from a Kennett police officer warning her about her actions. The cards stated, "You've just been paid a social visit by the Ku Klux Klan; the next visit will not be social." The officer claims that he only showed the family the cards to make them aware of the situation. Since that time, and after a dramatic plea for support, people have come to help Heather. The site www.SaveHeatherEllis.com has emerged, and her father appeared on CNN on the 15th of October to tell her story.
Dr. Towanna Freeman, a management consultant, argues that Walmart was to blame for the unfortunate sequence of events: "No matter what angle you take on this case, it all started when Walmart failed a valued customer and it's Wal-Mart that owes Ms. Heather Ellis a written apology."
Dr. Freeman goes on to argue that Walmart should have cleared up the disturbance as soon as it occurred, rather than allowing it to get out of hand.
When it comes to the trial of Heather Ellis, the bottom line is this: This young woman's future should not be in jeopardy over this incident. If the prosecutor's office could drop significant felony counts down to one misdemeanor, then they can drop the charges altogether. This may also be a case of what I call, "You got the wrong black person syndrome," in which police treat a black suspect a certain way because they believe the person is either uneducated or without influence. Most cases of police abuse go unreported or without accountability by the police department. Once they found out that Ellis was a college student, this may have led to the surprisingly generous concessions made in the original plea deal. There appears to be a power trip in this case, in which the prosecutor (like the one in the Jena 6 case) seems to feel that he has the right to destroy this young woman's life over an argument at Wal-Mart. I don't think we should let that happen. Rev. Sharpton and I will have something interesting to talk about this week.

You enjoy living in the fantasy land of anonimity don't you.... as there is no way being the coward that you are would say that to a person in real life otherwise you would be the lucky one and not be stomped to a pulp. There is no crime on any book in any county of the United States that says you can not hold place in 2 lines and get into the one that moves faster. WalMart does not have any signs in any store posted that says cutting the line is illegal. If rudness was a crime then you obviously would be locked under the jail. And unless you can find an example where anyone of any other race that has been treated as this woman has and is facing losing her VERY REAL freedom (not the fantasy tea-bagging fringe lunatic kind of 'freedom' WHICH you are probally one of) that is not not black then feel free to say that this is not racism. But until then stick to things you know like beer cans tabs for christmas ornaments, trailer parks and thinking that blacks are stealing something from you becuase you are a lazy stupid ignorant redneck loser.

RoC1909, I can't stand the generalizations through-out your post. I know of things white folks do, but I don't pin it all on whites as a whole, so don't pin the fact that some folk act ignorant on all blacks! If you read ALL the comments, most on here agree that the issue was she CUT THE LINE, read ALL of the comments, not a few and then say Black folk make excuses for all Black folks, I could say the same for Whites, but I know better, so I act like it. Everything is NOT racial, but we also aren't naive enough to believe that racial stereotyping doesn't exist. Get off of it. The lady cut the line, she was wrong, not to mention she acted a complete fool when the police came. I and NO OTHER Black person is no more responsible for her actions than you are. It's called personal responsibility that I am sure she realizes no one can accept for her, but her. Peace.

To Roc1909 How did she cut the line? WE do it all of the time. One person will get into one line and the other in another and we will see which one goes the fastest. Whatever one that goes faster thats the one we use. How is that cutting the line. Ok she cursed a police officer. Does that mean she gets 15 years for that. Didnt think so. This is AMERICA and its freedom of speach not for just one race but for all races of people. What do you feel that white people are Superior to other races. Didnt think so. I hope that she fights it to the end and she wins majorly. I hope she sues Walmart,the police dept and whomever else is involved. If she were white would this have happened? Didnt think so. We as blacks dont make this a race issue its you white people who does. But if you look at things they are turning it into a race issue with the KKK and all. I hope the prosecuter(s) get some punishment also because they are turning this thing into more than what it actually is. 15 years for speaking her peace. Nonsence.

I can't believe what some of these idiots are saying, You wouldn't understand unless you where black, this definitly happened in some hick town where blacks are still oppressed. Where are our black leaders, there should be someone on the way to help this woman. NAACP, Al sharpton, jessie? This is one of many incidents that happens to our brown and black brothers and sisters. When does it end? We must continue to make a stand on the streets and in the workplace. I am truly sadden by this. God help us.....

Are they really serious about this incident? Are they really trying to lock this woman up for 15 years because she spoke her mind? Do you know how many other people have cursed law enforcement out that DON'T get arrested??? I mean honestly people... there IS something called Freedom of Speech. As for the cutting of the line thing, we've all done it... more than once I'm sure, but is that really something to get all up in arms about? I used to work at Wal-Mart and I've seen people do EXACTLY what this woman and her friend did... did I get upset and tell the people they couldn't do that and caused a huge scene? NO! Why? Because it wasn't serious enough to even COMMENT on. Hell, I don't even remember a manager telling me that I had to say something if a customer cuts line! All they told us was to provide the best customer service possible, which this cashier apparently did not. Then, with the whole KKK thing... they have nothing better to do with their time besides wreak havoc on someone else's life.
To comment on Roc1909's ignorant rant, why are you even commenting on this situation? If you have that much hatred in your heart about how we, as black people, perceive an incident why would you read an article that was on BLACK VOICES???? Was it the fact that the KKK was involved and it made you all giddy inside? Was it the fact that another educated black woman had been stripped of her opportunites to excel in life because of this incident? Or was it because you thought your opinion really mattered? Truth be told, your opinion does not matter because you are ignorant to reality.
This whole situation is just ignorant in itself. I pray this woman doesn't have to endure this much longer so she can get on with her life.

I am seriously laughing at the white people coming on here and spouting that "OH YOU ARE JUST PLAYING THE RACE CARD" bit. Yeah, like "THE RACE CARD" is something black people pulled out of their arse to start ish. Its not like America was not built on racism and racism still runs deep within her veins (400 years and counting). We didn't ask to deal with this ish. Why don't you all go on Stormfront or confront the KKK and the ones who think like them about racism. You have NO IDEA what its like to be BLACK in America and you never will.
