A total of 12 witnesses all said that he was unarmed. In spite of this, a 73-year-old black man in Homer, La., was shot in a case that has sparked a great deal of racial tension in the area. What is most intriguing is that the grand jury refused to indict the police officer involved.
A grand jury gave a "no true bill" ruling in the case of Bernard Monroe, the senior citizen who was shot by officer Tim Cox. The ruling implies that the case will not go to trial, and the group rejected from consideration all charges, including murder, manslaughter and negligent homicide.
In this tiny town of 3,800, many citizens were outraged last February when Bernard Monroe, a man who was left voiceless by cancer, was shot by a police officer. The police have stated that Monroe was armed during the shooting, but witnesses are telling a different story.
The grand jury heard 20 witnesses over a two-day period, according to Kurt Wall, director of the Criminal Division of the State Attorney General's office. The local prosecutor recused himself, causing the Attorney General to step in.
"We believe it was a full, complete, accurate and thorough presentation conducted at a neutral site. We respect the grand jury's decision," Wall told the media.
The situation has not yet come to an end. The Federal Bureau of Investigations (FBI) is now stepping in to investigate the case. Also, the local chapter of the NAACP is angered by what has happened to Mr. Monroe.
"I am so disappointed," said the Rev. Willie Young Sr. "When you have 12 witnesses that say the man did not have a gun, and he was gunned down by police, what are you supposed to believe? We are left with the belief that police in Homer have a license to kill."
According to reports, Bernard Monroe was shot by Officer Cox on February 20, after Cox and another officer were chasing Monroe's son through the house. They eventually shocked his son with a stun gun in the yard. Bernard Monroe was in the yard with several family members at a cookout when the incident took place.
When it comes to the Bernard Monroe shooting the bottom line is this:
1) We cannot jump to judgment in this case: The FBI has come in to investigate. I am hopeful that after due process has occurred, we can get to the bottom of this incident. The Rev. Al Sharpton, however, has already held a march in the area, and in spite of what some may think about Rev. Sharpton's involvement, I am well aware that he does a thorough investigation himself before deciding to intervene in police-shooting incidents. There appears to be evidence that this shooting may have been an abuse of police authority.
2) If police did abuse their authority, this is reflective of a problem that is far too common: All across the country, many citizens are afraid of the police. It should not be the case that in a supposedly free society, we must be fearful of another human being arbitrarily applying his wrath on to those who disagree with him. I've seen cops go overboard on multiple occasions for no good reason, and the day of the rogue police officer must come to an end.
3) Let's hope this is not a case of dirty small town justice: When my team worked on the case of Heather Ellis, the college student who faced 15 years in prison in an incident that stemmed from her cutting a line at a Walmart, I learned a great deal about how things happen in small towns behind closed doors. Nowhere is this more true than in the South, where people are consistently arrested for crimes they did not commit. One case that comes to mind is that of Rodney Stanberry, a man for whom there is very little evidence to support the years he has spent serving time for a murder conviction. Another is the case of Jamie and Gladis Scott, two sisters who have served a number of years for a crime that many believe they did not commit. What is most sad about this reality is that the justice system still does not work in favor of black people, especially if they are poor. Additionally, this system is destroying black families everywhere.
I call on organizations, such as The National Black Law Students Association, to get to the forefront of these issues and use their legal expertise to systematically confront these issues and bring long-awaited justice to the African-American community. If they don't step up to the plate on these issues, then no one can. We've got to work together to make this situation right.

It does happen everywhere....constant issues between police officers and the black community. I remember a time when it seemed to be safe to go to a police officer but these days you gotta think twice! It's a damn shame....

I live in New Orleans, and it has racial problems. Unfortunately, racism didn't die with the NAACP parade to bury the "N" word! It just went underground, and what better place to hide than some small Southern town where no one is likely to tattle on a friend! America needs to bury the "N" attitude along with the word!!

Do not let Dr Watkins take the good people on BV for fools. I read about this last year, and found info on many web sites to make sure I got as much info as possible before passing and kind of judgement w/out actually being there. DR WATKINS HAS LEFT OUT MANY MANY FACTS!!! First he mentions nothing about the fact that the gentleman in question did in fact keep a pistol stashed on his porch! He family's reason for this was that he was a avid hunter???? So if that is true why keep it on the porch and why a handgun?? It was well know in his family that the gun was stashed on the porch so much so that one of them had told the press "the kids all know it's there but know not to touch it". Sorry but that is not some thing that you trust that kids will obey. Kids are always curious about things that they are not supposed to touch. so right there Dr W lied to every one on here cause he knew that there was a gun involved and that is why the courts did not proceed with charges. This is not to say that there are bad cops out there. And when we encounter them we should convict them. but this is not the case in this situation. Plus if they were so trigger happy (as Dr W puts it) why did they not shoot the grandson who was the one the were chasing in the first place??? Because they are good cops, they only shot the grandfather cause he pulled out his hand gun from the porch and forced them to fire on him. As for the witnesses, they were all the guys family that were there at the house, of course they are not going to say their grnd father had a gun. Not to blame them but come on! So why does Dr W like to get people on BV all pumped up about hating white's and cops with half truths?? I really don't know. He is smart enough to know what he is doing (misleading readers) so i can only imagine that he has some motive other than truth. The main problem is he is going to get some young black killed!!!! I agree with Jeromequigley, some of the stories that Dr. have on here don't seem to do much good, only make some people angry including myself. I have noticed that some of the stories really don't make a lot of sense and it seems like he wants to promote hatred among the races and blacks. I know personally that there are a lot of bad police but then there happens to be some very good police officers that are white. I lived next door to a Neighborhood Resource Office in the projects that was needed and I told the police officers I didn't trust them, especially when there happens to be 2 or more white ones. In the 8 years that I lived next door to them not only did they gain my trust but they also looked out for me and my 3 children. When my 16 year old son was robbed coming home from work by some black kids that he went to school with, I told the officers and they talked with my son about it. Those officers went to the school got a year book and had my son pick out each one of those little thugs, then they arrested them, went to court with it and got my son his money that they robbed him of. Yes there happens to be some very good white officers right here in our city and don't forget we have some very bad, crooked black officers here on our force. I do live in the south so I have seen some good and bad yet I still feel like our white officers can be trusted in the black community here in Greensboro, North Carolina so Dr. I don't buy your mess.

What many who have written comments are not aware of is how many white police officers shot unarmed Whites. How many White people have White police officer murdered who they THOUGHT had a weapon. White police are now across the country are legally lynching/murdering Blacks with the protection of the Police Codes and all white Grand Juries. I have seen inside how white police officer treat Blacks and compared to Whites. An ex Black Police Officer here.

Apparently the amount of individuals who witnessed this shooting, were invisible, mute, deaf and dumb as far the the Grand Jury was concerned. There words meant nothing. The really sad thing is...regardless of your race or culture, you might need somebody someday that you have truly wronged. Acts of injustice only serve to keep stoke the fires of anger. Which I suspect is what the powers that be want. The vast majority of human on this planet are very poor..keep them in conflict and economic straits. Thank God humans have short life spans, I shudder to think what it would be like if they lived indefinitely. Some hate needs to disapate and the one thing that takes care of that is...moving towards the bone yard

Don't jump to conclusions, something tells me the author of this article is not presenting everything the grand jury heard. What were the actions of the accused?
One thing is for certain. Boyce Watkins likes to write articles that rile up the blacks that read this website. That's called "race-baiting".
The FBI has come in to investigate, which is appropriate given the number of contrary witnesses. If the cops were lying or if they used excessive force given the circumstances, they should not only be fired, they should be prosecuted. BUT if the accused and his witnesses are lying or acted in a way that justified what the cops did, they should be prosecuted, not just for the original crime but for perjury.
