Federal officials are not planning to pursue charges against the officers involved in the shooting death of Sean Bell, an unarmed young black man who was set to be married the following day. The officers fired more than 50 shots in to a car that held Bell and his friends, when the officers supposedly thought the men were retrieving a gun. No gun was ever recovered.
The officers were undercover, and the shooting sparked outrage throughout the black community.
Prosecutors claim that there was "insufficient evidence" that Bell's civil rights were violated. Three officers were acquitted in 2008, including Michael Oliver, an officer who reloaded his gun while shooting 31 of the 50 shots that went in to the car.
Bell's family and his fiance, Nicole Paultre-Bell, were saddened and disappointed by the decision. They'd asked federal officials to become involved after the original acquittal.
"Why didn't they take a chance and go with a jury," Bell's father, William Bell said. "They say they didn't have enough to go with the evidence. What kind of message are they sending kids? It's open season. They can do what ever they want."
The Rev. Al Sharpton, who has advised the family on the matter, spoke with Attorney General Eric Holder about the incident.
"I expressed to him my extreme disappointment in the decision and our legal advisers saw the evidence and federal jurisdiction differently," Sharpton said in a statement. "We agreed, however, that the family and community must continue to bring a new day in how we deal with police matters and how both community residents and police are protected equally under the law."
What's most interesting about the Sean Bell shooting is that while federal prosecutors are refusing to get involved in the case, there has been no serious explanation to the public regarding why the officers should not be charged. There is no conversation about what avenues of police discretion allow these officers to shoot dozens of bullets at unarmed citizens, reload their guns and continue firing. I want questions answered, and the idea that this case is going to come to an end without any closure for the American people is incredibly disturbing.
My father was a dedicated police officer for 25 years, which gave me an opportunity to see the inside of police work in ways that others cannot. I also speak regularly with civil rights leaders who speak up against police abuses of authority, which occur throughout our nation every single day. I am also a black man, and I've known the fear of police intimidation up close and looked in to the eyes of an angry, arrogant officer who felt that by simply talking back to him, I was somehow "stepping out of my place."
Attorney General Eric Holder has consistently missed opportunities to address the broader problems of black men in the criminal justice system. While African-American families are being consistently destroyed, Eric Holder, President Barack Obama and others are simply focused on keeping their jobs within a system that is (hopefully) not in line with their inner conscience. Only radical action will change the consistent violation of black civil rights taking place within our incredibly flawed system of justice, and our nation must be committed to that action.

There is no justice today, as there was no justice yester year. If you're white you're right, if you're black you get jacked. How many bullets does it take to kill a unarmed man? If you're a cop and he's black, not enough. I taught my children to respect the law and the police were their friends. Respect the law yes, respect the police, I don't know if that was the right thing to do. They are nothing more than trained assasins with a itchy trigger finger targeted towards men of color.

It's not just black men this happens to. And it's not just the police who do these deplorable things. Sociopaths are in abundance and they wear many faces... How do any of us protect ourselves from them? How do we protect our friends, our loved ones, our neighbors??? They have no conscience and they bring their cruelty for it's sport and not because their victims have done anything at all to deserve it.

I agree with some of your points Dr. Watkins, however, in this situation I can't imagine how Eric Holder can do anything. We could have investigations from now until next year, but if the decision is based on the rule of law and certain elements that are needed to be satisfied aren’t, then his hands are tied. This problem would have to go back to the legislature in their construction of our laws. I don't know the details of what happened in that investigation and I don't want to speculate, my only guess is that the elements were not met, therefore, no charges can be brought. Sometimes the notion of "justice" can be arbitrary.

Whenever black rights are violated the law then becomes arbitrary. Niether the commander in cheif nor his top cop(who is from Queens, NY I might add)could care less about the blood the share with Africans. We are to "American" for them to give a dam!!!

Everyday, I wake up to someones pure ignorance. Eric could have done something if he so chose too. You've never heard of the cops killing ANY WHITES in the manner in which they KILL BLACKS PERIOD. No matter how horrendous the crime. Yet walking while black ESPECIALLY A BLACK MAN, you can get shot as much as they want want no recourse of action. The mind control of the black race is running ramped and it's getting worse. The more we become educated in the white mans educational system dumber we become as a people. Racism is all this is and until we take matters into our on hands it not going to change. I see that we're full of faith and optimism but no actions behind it. Every time someone Black stands up for our people they are chopped down by one of massas n...... form the plantation. Seek wisdom because that's what's needed at this point.

I agree with ANTHONY that when the law concerns ppl of color, it doesn't matter if there is significant evidence or not. Why do we have so many people of color who have spent years in prison being released today due to new DNA technology. The sad thing is that those are only the cases where DNA was collected and saved properly. Who knows how many ppl have been sentenced to death(which is what these officers did to Sean Bell) or life in prison for crimes that had shaky evidence. But they hadn't went thru anybodies police academy, giving them the rights to take away innocent mens lives.

Eric Holder had made a statement months ago that he wanted to adress racial profiling and other judicial issues related to race. He can start with this case.
