Brooklyn Mom Jailed for Refusing to Send Young Son to Visit Imprisoned Serial Rapist Dad

Sukhwant Herb was sentenced to 50 days in solitary confinement on Riker's Island for refusing to allow her 9-year-old son to pay a visit to his dad, who is imprisoned for raping several women, two of which were teens.

The brave mom stuck to her guns and ignored a court order mandating her to send her young son, Seon, to visit his father twice a year at an Arizona state prison. The boy's father, Seon Jonas, 31, who was convicted back in 2003, is serving a 27-year sentence for raping three women.

While the 29-year-old woman did agree to visitation back in September, she chose not to abide by her original agreement and told the New York Daily News in a phone call:

"I don't want my son in that environment, seeing the prisoners in jumpers, and the slamming of gates, the noise. My son is 9, and it's horrible, horrific."

According to the spokesman for the state Office of Court Administration, David Bookstaver, the East, N.Y., mom was given ample opportunities to modify the court order for visitation. Bookstaver also says that Herb was negligent with answering simple questions, such as where her son went to school in order to avoid doing jail time. He also told the Daily News that she missed a total of five court dates.

Herb, on the other hand, refutes what Bookstaver says:

"I kept telling the judge where I was living, that I had a house in Ohio and was planning to move there with my son. But [the judge] kept screaming at me, 'I don't believe you, I don't care. I don't believe you.'"

Dwayne Waithe, Herb's fiance with whom she has a 6-month-old, claims that he was more than willing to surrender his home, trucking business and all the money he has in his possession for his fiancee's bail. The judge did not accept his offerings to make bail for Herb.

Dale Frederick, Herb's attorney, says, "It is not in the best interest of any child to incarcerate his mother for refusing to allow that child to go to a penitentiary, particularly where the father is a convicted serial rapist."

Herb met her son's father back in 1999 in New York City. The couple moved to Phoenix and until Jonas was arrested, Herb claims she did not have a clue about her boyfriend's demented alter ego. "I had no idea of his secret life, that he did that," she said. "He was a kind man, was never abusive to me when we were living together."

Of her time in jail, Herb says:

"I'm locked here in a room, locked in 23 hours a day, with a TV.

"I turn [the TV] on just to hear another voice. The first time they took me outside for some fresh air was after 13 days in jail and that was for only one hour."

Herb remains in prison.
