A federal judge handed a victory to supporters of illegal immigration yesterday by blockinga tough new law in Arizona that would have required police officers to check a person's immigration status while enforcing other laws.
U.S. District Judge Susan Bolton also provided cover for federal lawmakerswho have ducked and dodged the complex issue of how to curb illegal immigration and have forced states that border Mexico like Arizona to pass their own laws to deal with the issue.
Arizona leaders will likely appeal the ruling to overturn Bolton's order which takes effect just a day before the Arizona law was supposed to take effect.
Bolton's order stopped parts of the Arizona law that would have required immigrants to carry their papers at all times and that would have made it illegal for illegal aliens to solicit work in public places as day laborers commonly do.
Bolton reasoned that checking immigration status "burdens lawfully present aliens because their liberty will be restricted while their status is checked."
I think Bolton'sreasoning is flawed because we all, at some time or another, have our liberty restricted in the search for illegal activity.
If so, your liberties were restricted when the officer checked whether you had been drinking. Assuming you hadn't, the officer sent you on your way. I'm not sure how many sober people are inconvenienced in this search for drunk drivers but society has determined that the brief "restriction" on our liberties is worth it.
In the same way, a brief inconvenience of legal U.S. residents in the search for illegal residents should be tolerated.
I'm no lawyer but if the biggest legal hurdle to the implementation of the Arizona law is that it inconveniences people in the search for criminals, Bolton's ruling will likely be overturned down the road.

that judge needs to be removed from the bench. Az. has a right and a duty to its citizens to keep these criminal illegal alians out of our nation. Sadly she was hyped up on the media spin of some liberal extremisist media channel. Dear Family, I find it exceeding annoying that no one (or at least not enough people) are connecting the Arizona Immigration Law to the nation wide policy of "stop and frisk" which is operating on a daily basis in community of colors. I live in a housing development is Harlem and prior to workshops, lawsuits, and outright "hell no" from the people, we were being asked to produce ID on general principle! It was so bad that I informed the police at every community meeting I was at where the issue came up that I will not walk around with ID while in my community and that I have no expectation that I will be asked for ID! I told them quite succinctly that my New York State ID will not be used as a South African Pass! I have heard stories of police asking Black men for ID who were in the hallway emptying the garbage into the incinerator! People who either live in a particular building or are visiting people in other buildings have been arrested and given trespass tickets for not producing ID. What makes it worse, is although I disagree with the Arizona Immigration Law (I am not about to blame Mexicans for any of the woes of this country) it is a law. "Stop and Frisk", "Operation Clean Halls" (for the trespass program) are not laws, they are law enforcement policies or programs which have not been legislated by any level of government, be it city, state, or federal, yet these policies are being enforced as LAW! I am not aware of any legal change in the government structure which gives the policing powers of this nation the right to develop or pass LAWS! There is no laws on the books that require citizens to carry ID and police have no right to approach anyone without probable cause! On another note, perhaps if this law is dismantled, then arguments against "stop and frisk" will be strengthened. On an end note, I think that it is disgusting the way Mexicans are being stereotyped or marketed as "Hard working Mexicans". They do not work harder than anyone else and have been used to diminish the hard won gains of American Workers everywhere due to their supply of cheap labor. I am not blaming them, but like other groups they have been and are being used to divide the country further. On an end note, NO ONE HAS WORKED HARDER IN THIS COUNTRY THAN AFRICAN OR BLACK AMERICANS! Things like 'operation clean halls' wouldn't be necessary if not for all the crime and violence. Yes, some good people are going to be harassed a bit, but if you're not doing anything wrong, it seems a small price to pay for improved safety and sense of community.
The Federal government should have cracked down on property owners and business owners. Fining them for hiring and renting to illegal immigrants. All this outrage over illegals but none for businesses that hire them over American citizens for pennies on the dollar...or slumlord property owners who squeeze them in one bedroom apartments a dozen a time. We didn't mind exploiting illegals until the bottom fell out of our economy. Our anger and outrage should not only be towards the government and illegals but targeted toward the right people who started this..PROPERTY OWNERS who rent to them and BUSINESS OWNERS who hire them!! Every job or apartment I lived in I had to show legal residence with a state issued ID AND a social security card. The government needs to start throwing these business owners and property owners in jail!
