Conrad Murray Seeks Dismissal of Michael Jackson's Death Lawsuit‎

On Wednesday, Dr. Conrad Murray's legal team requested that a Los Angeles federal judge dismiss Joe Jackson's wrongful death lawsuit against their client.

Murray, a cardiologist who was Michael Jackson's physician at the time of his death, is accused of administering a fatal overdose of the anesthetic propofol, which the superstar celeb used as a treatment for insomnia. Murray was charged with involuntary manslaughter; he has pleaded not guilty and is awaiting trial.

Murray's lawyers argue that the Jackson patriarch is not a beneficiary of his late son's multimillion-dollar estate, nor was he mentioned in the will. Therefore, the legal team argues, his lawsuit should be dismissed.

The attorneys also contend that the lawsuit, which was filed by Jackson on the first anniversary of his son's death, on June 25, is full of arguments and statements that hold no bearing and should be removed:

"At its essence, [Joe Jackson's lawsuit] is a press release that is intended to prejudice and inflame the jury pool and the public" against Murray and his medical practice," the lawyers argued.

According to the lawsuit, Jackson alleges that he has suffered more than $75,000 in damages. Jackson's lawsuit also contends that Conrad was negligent in allegedly giving Michael a mix of sedatives, which eventually led to his untimely death at age 50.

Jackson's attorney, Brian Oxman, though, is affirming that the lawsuit was in fact in order and drafted accordingly. He told the Associated Press:

"It sets out facts. It doesn't set out anything other than the day-by-day, moment-by-moment description of what happened."
