Once a hot gal-about-town and now a sedate stay-at-home mom of two, Nicole Richie sent her legal team to an L.A. court to take out a restraining order against a paparazzo who has been stalking her daughter at the preschool she attends.
Richie contends that photographer Fabricio Luis Mariotto (pictured below) incessantly lurks around her daughter's preschool hoping to snap pictures of 2-year-old Harlow. Richie was so incensed by Mariotto's brazen ways that she decided to snap some pictures of her own, showing the stalker going about his dirty deeds at the preschool. Richie then attached her pictures of Mariotto to the restraining-order petition that she filed to support her case.

Richie states, "[Mariotto] drives erratically around my children and others, yells, screams and attempts to scare us so that he can photograph our reaction. He trespasses on preschool property to photograph the children." The mad mom also adds, "He has often left his car in the middle of a busy street just to chase me for a photograph."
Lawyers who represent Richie appeared in court and secured the restraining order on behalf of both her children. The socialite, fashion designer and actress also has a 14-month-old son, Sparrow. The father of both children is Good Charlotte's lead singer Joel Madden.
A judge granted Richie a temporary restraining order that requires Mariotto to stay 100 yards away from her and her family.

That's not how you deal with these creeps. you use violence, and they sue you. Even if they aren't successful, they still have media coverage. What she should have done was to get all the businesses near the pre-school and any residences to post no trespassing signs and tell him to leave. I can't imagine any other parents at the pre-school are all that happy of weirdo trying to get pics of the tot, since he could get their kid too.

Sorry, but hanging around a preschool to get a photo of a 2 year old child of a celebrity is just creepy and kind of makes me think CHILD PREDATOR. You go, Nicole! You have to protect your babies from creeps like this guy! And, if it was me, I'd call the cops every time I see him! He looks suspicious to me, and by protecting your kids, you are also helping to protect the rest of the kids he's stalking.

Too bad the judge couldn't see thru the celeb culture of special treatment, and render the verdict- "You brought this upon yourself, Young lady.... and now you want a court to let you have access to more rights and privledges than a regular working stiff can get, due to your continuous partying and co-called socialite ways??? No. This court is adjourned- Case dismissed!"
No judge seems to possess this view there- Too bad they don't.
This is what keeps things so $$$$$$$ in our daily lives. The famous and wealthy get more consideration than the rest of us.

Contrary to your mistaken beliefs, anyone can apply for a restraining order, and if you show sufficient cause, it will be granted. For instance, abusive husbands in ugly divorces often have restraining orders taken out against them by their wives who feel threatened. Same with stalker ex boyfriends and girlfriends. Belligerent former employees often have restraining orders taken out against them by their former employers.
I know it feels good to rail against celebrities and the wealthy, but in this case she is absolutely correct and is doing what any mom, famous or not, would do. She's protecting her child from harm and the invasion of her privacy. She has the same 4th Amendment rights as any other citizen, and the judge weighed that against the photographer's 1st Amendment rights, and correctly found for the plaintiff.

She brought this upon herself? Even if one does follow your idiotic line of reasoning then maybe she did bring upon herself, people following her around that is. But not upon her children. Also if you, as a working class stiff, do gather evidence of an adult stalking your child then yes you can get a restraining order on them. There are limits to what people should be able to do. Stalking children so they can make some money should not be allowed. There are strict rules in England against the paparazzi being allowed to do this and the same laws should be in effect here.

I don't think you understood the point of the article Denny my boy! The point was that she (mom) was getting the restraining order to protect her children -- not to stop him from taking pictures of her, only her children (who did not ask to be hounded at pre-school).
Try to think things through BEFORE you speak. You may sound a little (and I mean a little) smarter.
