So much for their amicable split.
Halle Berry is planning to take ex Gabriel Aubry to court to fight for custody of their 2-year-old daughter Nahla. The Oscar winner, 44, even cleared her schedule by pulling out of the star-studded flick 'New Year's Eve,' which is set to begin filming in New York City this week. (She's being replaced by Katherine Heigl.)
"Halle Berry was forced to pull out of a film production in New York this week due to pending custody litigation involving her daughter," her rep tells UsMagazine.com in a statement. "She has attempted to resolve these custody issues amicably with her daughter's father, Gabriel Aubry, directly, but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention."
Behind her decision to head to court?
"Halle has serious concerns for her daughter's well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her," her rep adds.
Though the twosome were often seen cordially co-parenting in the wake of their April split =- including a shared trip to Paris -- the model, 35, filed papers on Dec. 30 asking to be formally recognized as Nahla's father and to establish shared custody.

And if Halle had gone to a sperm bank how would you feel, as a sister, about her requesting WHITE sperm?? Which is essentially what she did anyway. Truth is, she likely bit off more than she'll be able to chew because Gabriel Aubry is not "broke" and made a high-end living as a male model long before he met Halle. Her identification as "black" in front of the tabloid media will be sure to grant Aubry preference and brand Halle an "angry black woman" as this debacle plays out...

Correction: A MAN MIGHT NOT BE ABLE TO KEEP ME because men rarely admit to being crazy, jealous, insecure or "their"flaws when comes to a relationship but are schooled in making the woman totally responsible when a relationship ends. READ sexist Title of Article. I also may not may choose men worth keeping or married beneath myself however I am a devoted mother and will make sure that my childs' best interest come first. LASTLY, A WOMAN DOES NOT NEED A MAN TO MAKE HER WHOLE.

No, she doesn't. BUT, she does need something ONLY a man can provide in order to be a mother. It's convenient and unsettling that Halle seems to be consistently able to position herself as The Victim however she rolls. How does that fit into the profile of being a "strong Black woman"? These people are actors and entertainers. By definition, they're high-strung, attention-seeking, ego-maniacs. How does that make Halle right and the "good guy" in all this. The facts are not even on the table yet...

From huffingtonpost.com I know men who are a little jealous when their baby mama moves on without them, try to exert some control over by refusing to allow their child to travel. This has caused women to refuse jobs, or moving to a new location. the sad part is, sometimes they are not even that involved with the children--they just exert their power given to them as the father. With him having shared custody, he does not pay child support.
In his case, it is his revenge is a little sweeter, because Halle has to pay for his babysitting services. Halle has a new man and he is jealous --I hope he meets someone else soon so he can stop following her around under the guise of wanting to be with his child.
I can't believe he put himself in the position where Kim K. called him an attention grabber, trying to bask in her sun.

What does this say about Halle, the fact that she's so willing to put "her new man" in front of her child in a very public way with old business still unfinished and pending? A "he said - she said, he did - she did" legal drama on public display played out in the tabloid press? How is that good for Nahla in the long run? What kind of a statement does it make to a young girl watching her mother behave that way...

I'm sorry, but I am not on Halle's side with this. We have so many men (of every color) running from their responsibility, that it is refreshing to see men take on the role of parenting. I think that we all have to look at the big picture when it comes to her. She has been married twice, and divorced twice, the common denominator in this equation is her. You can't always say it was the man's fault, you have to sometimes look at yourself.
I think it is very selfish of her to deny this man his parental rights, and any of you are foolish to think this has anything to do with him being jealous of her new relationship! That man can have any women he wants, he is gorgeous! I think if anyone should be questioned it is her, she has been pictured with her new beau and her little girl, which I think it is a little to early to be bringing a new guy in the picture. SMH!

He is not doing this because he so desperately wants to be a a real father. The child is already his. He wants to be recognized as 'Halle Berry's baby's father' to stay relevant. Also with shared custody Halle may have to pay him child support. Courts often do this in order to keep even income in both households. I dont see this a an innocent wanting to be in his child's life type thing. He's already in her life.

E: In the court of law, you have to be legally filiated with a child if you want custody. That is why he wants a formal acknowledgment. This can be done in numerous ways such as by a paternity test. It isn't like he and Halle would have to hold a press conference. This has nothing to do with relevancy on his part it is purely legal. Smac you are so right. I couldn't have said it better myself.

Here we go again with Halle bashing another man that she no longer has use for...do we remember David Justice and Eric Benet? Halle likes to get her version out first, loud, and clear. All three of these men can't be as bad as Halle says; she's the common denominator in all three relationships!
